Judgment has been handed down in case of Greek Cypriot Meletis Apostolides against British Coulpe David and Linda Orams in favour of the Greek Cypriot, according to the statement of his lawyer. This final appeal is absolute and Orams will not be able to apply to the Supreme Court of UK anymore.
According to the verdict the Cyprus judgments are to be registered and enforced in the UK.
There were a number of orders made by the Cyprus Court against David and Linda Orams about the land in Lapithos, which belongs to Meletis Apostolides.
Order of the Cyprus Court stipulates the following:
- Trespassing the land belonging to Apostolides must cease
- Land must be delivered to Mr. Apostolides
- Rent must be paid to the Greek Cypriot in respect of the period of their occupation
- The villa its fencing built by Orams must be demolished
- Orams must pay certain sums for the Apostolides' costs of the proceedings
Apart from that Orams will have to pay for the legal fees, which Mr. Apostolides was exposed to during the Luxembourg and London proceedings.
“This judgment has determined in a final way that the legal rights of displaced Cypriots against trespassers, as determined by the Courts of the Republic of Cyprus, can be enforced in the United Kingdom,”
was written in the statement of Constantis Candounas, lawyer of Meletis Apostolides.
“Mr. Apostolides feels totally satisfied that the European institutions have safeguarded his right to have his human rights to property enforced throughout the Union.”
Mr. Candounas also stated that this judgement will stand as a future obstacle for speculators in stolen Cypriot properties, as well as those who are thinking to risk their investments. It opens way for all the Greek Cypriots to take action against other EU nationals trespassing their properties located on the territory of Northern Cyprus.
